SoyNut Butter Company (“SoyNut”) filed a Chapter 7 bankruptcy on May 12, 2017.  The bankruptcy case was filed in the United States Bankruptcy Court for the Northern District of Illinois, Eastern Division.  The case number is 17-14970.  SoyNut marketed soynut butter, a nut-free substitute for peanut butter.  SoyNut also marketed granola and other products incorporating soynut butter.

In March of 2017, the Food & Drug Administration (“FDA”) and the Center for Disease Control (“CDC”) advised SoyNut of a multi-state outbreak of E.coli illness linked to SoyNut products.  The discovery of E.coli bacteria in SoyNut products caused SoyNut to institute, on March 3, 2017, a voluntary, nationwide recall of its I.M. Healthy Original Creamy Soynut Butter products with Best By dates of August 30 and 31, 2018.  Later, SoyNut, on March 10, 2017 expanded its voluntary recall to include other SoyNut based products with various other Best By dates.

SoyNut’s products were manufactured by Dixie Dew Products, Inc. (“Dixie Dew”), located in Erlanger, Kentucky.

On March 27, 2017, the FDA suspended Dixie Dew’s Food Facility Registration, shutting down Dixie Dew’s Erlanger, Kentucky food processing plant where it manufactured SoyNut Butter products for the Debtor.

Shortly after the E.coli outbreak and Dixie Dew’s production shutdown, SoyNut filed its Chapter 7 bankruptcy case.
